Naples Picasso Flowers
Terms & Conditions
Effective October 5, 2026
These terms apply to your use of naplespicassoflowers.com and to every order placed with Naples Picasso Flowers LLC (“Naples Picasso Flowers”, “we”, “us”), whether online, by phone or in person. By placing an order or using this website, you agree to them. Weddings and events are also covered by a written proposal. Where your proposal and these terms differ, your proposal applies.
1. Orders and payment
- You must be 18 or older to place an order.
- An order is accepted when we confirm it. We may decline or cancel an order, for example if an address is outside our delivery area, a price was shown in error or payment cannot be verified. If we cancel an order, we refund what you paid for it.
- Payment is due in full before delivery. Online orders are paid at checkout through our payment processor, Square.
- Prices are in U.S. dollars. Delivery fees and sales tax are shown at checkout before you pay. Any tip you add is voluntary.
2. Our designs and substitutions
- Every arrangement is designed by hand from fresh flowers. Photos on this website show examples of our work. Your arrangement will match the size, style and color palette you ordered, while the exact flowers, shapes and shades will differ from the photo. Colors can also look different from one screen to another.
- With Designer’s Choice, you choose the size and the palette or occasion, and our designer chooses the flowers.
- If you need a specific flower or color, tell us in your order notes or call us, and we will confirm it before we design.
- If a flower or a container is not available at the quality we expect, we replace it with one of equal or greater value that keeps the style and palette of your order.
3. Delivery
- We deliver in Naples, Marco Island, Bonita Springs, Estero and Fort Myers. Other areas are possible by arrangement and at an additional charge.
- For same-day delivery, order online by 11 AM or by phone by 1 PM, Monday through Friday. Later orders are delivered on the next available delivery day. The dates available for your order are shown at checkout.
- We do our best to meet a requested time of day, but we cannot guarantee a specific delivery time.
- You are responsible for a complete and correct delivery address, including any unit number and gate code, and a phone number for the recipient.
- If no one can accept the delivery, we call the recipient or you. We may then leave the arrangement with a front desk, a gatehouse, a reception or a neighbor, leave it in a safe place, or bring it back to our studio. If a delivery fails because the address or access details were wrong or incomplete, a second delivery may carry an additional delivery fee.
- Hospitals, funeral homes, churches, hotels, clubs, offices and gated communities have their own rules for deliveries. Delivery is complete when we hand the arrangement to their staff.
- Delivery to cemeteries and rural route addresses cannot be guaranteed.
- If you choose self pickup, the pickup details are confirmed with your order.
4. Changes, cancellations and refunds
- Flowers are perishable and every order is made for you, so all sales are final. Flowers cannot be returned, exchanged or refunded.
- If you need to change or cancel an order, call us as early as possible. We can make changes only before we have bought flowers or begun design work for your order.
- If your order arrives damaged or is not what you ordered, contact us within 24 hours of delivery with a photo. We will review it and decide on a fair solution.
5. Flower care and safety
Flowers and plants are for decoration only and must not be eaten, chewed or swallowed. Some flowers and plants can be harmful to people or pets, and some people are allergic to them. Keep arrangements out of reach of children and pets. We are not liable for harm caused by eating flowers, plants or any other item bought from us, or by allergic reactions to them.
6. Weddings and events
Wedding and event work is described in a written proposal. Unless your proposal says otherwise:
- A non-refundable retainer, normally 50% of the total, is due when you sign your proposal. It reserves your date and our services.
- The remaining balance is due six weeks before the event, unless your proposal names another date. We deliver and install only after payment has been received in full.
- Changes to your order can be made up to six weeks before the event. After that, only minor changes are possible, because flowers and materials have been ordered. We confirm the final details with you about three weeks before the event.
- Cancellations must be made in writing. If you cancel six weeks or more before the event, we refund what you have paid beyond the retainer. If you cancel later, the full amount of your proposal is due.
- Overdue balances may carry a late fee of 1.5% per month. If we have to collect an unpaid amount, you agree to pay our reasonable collection costs and attorney’s fees.
- Naples Picasso Flowers is an independent studio. You are responsible for confirming that your venue allows your chosen florist, and for giving us the venue’s rules, access times and contact person.
- Set-up and breakdown times are agreed in your proposal. Extra labor caused by schedule changes, venue restrictions or access delays may be charged.
- Candles and open flame are used only where your venue allows them.
- Please check the installation with our team at set-up. If anything is not as agreed, tell us on site so that we can correct it before your event begins.
- Our proposals, sketches, mood boards and design concepts remain the property of Naples Picasso Flowers. Please do not share them with other vendors or have them produced by someone else.
7. Rental items
Some events include items we rent to you, such as vases, stands, candle holders, textiles, ribbons and sashes.
- Rental items remain the property of Naples Picasso Flowers. If an item becomes unavailable, we replace it with an equivalent one.
- Please count and check rental items when they are delivered, and tell us about anything missing or damaged before your event begins. We cannot accept complaints made later.
- During the rental period you are responsible for the items and use them at your own risk. This includes loss, theft and damage, also when caused by guests or other third parties. Items left outdoors are at your risk, including damage from rain and wind.
- We charge the replacement value for items that are lost, damaged or handled improperly, for example through burns, cuts, mildew, tape or pins. Please report loss or damage to us in advance, or at the latest when we collect the items.
- Candles must be fully extinguished and cool before items are packed. On the collection day, all items must be complete, packed in the packaging we provided, stored in one dry place and ready for collection. Textiles must be completely dry when packed, to prevent stains and mold. If items are not ready on the collection day, a second collection trip may be charged.
- Heavily soiled items carry a special cleaning charge. Items with heavy wax are charged a service fee of $40.00 per piece. Ribbons and sashes returned knotted are charged $1.00 per item.
- We check all items for completeness and condition when they are back at our warehouse. Service and cleaning fees are due at once.
8. Photographs of our work
We may photograph our floral work, including at your event, and use the images in our portfolio and marketing. Client names are never published without written consent. If you would prefer that we do not show your event, please tell us in writing before the event.
9. This website
- The text, photographs and designs on this website belong to Naples Picasso Flowers or to the people who licensed them to us. Please do not copy or reuse them without our written permission.
- Venue, club and brand names on this website belong to their respective owners and are used only to describe where we design and deliver. Naples Picasso Flowers is an independent studio and is not affiliated with, sponsored by or endorsed by them.
- If you send us a review or a photo, you allow us to show it on our website and in our marketing.
- Please do not misuse this website, for example by placing false orders, interfering with how it works, or collecting information from it by automated means.
10. Accessibility
We want everyone to be able to use our website. If any part of it is difficult for you to use, call (239) 297-0352 or email us, and we will help you and take your order personally.
11. Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as hurricanes and other severe weather, evacuations, road or bridge closures, power failures, failures of suppliers or carriers, or government orders. If such an event prevents a delivery, we will contact you to arrange a new date or another fair solution. For weddings and events, your proposal applies.
12. Warranties and limit of liability
Flowers are a natural product. Apart from what these terms and your proposal promise, we provide our products, services and website as they are, without warranties of any kind, including the implied warranties of merchantability and fitness for a particular purpose, to the extent the law allows.
To the extent the law allows, our total liability for any claim connected with an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses.
13. Your responsibility
If you misuse this website or rental items, or do not follow these terms, and this leads to a claim against us, you agree to cover our resulting losses and reasonable costs.
14. Governing law and disputes
If something is not right, please contact us first. Most concerns are resolved with one call. These terms are governed by the laws of the State of Florida, and any legal dispute will be brought in the state or federal courts serving Collier County, Florida.
15. General
- We may update these terms. The version posted on this page when you place your order applies to that order.
- If a court finds part of these terms unenforceable, the rest remains in effect.
- These terms, together with your order confirmation or your proposal, are the whole agreement between you and us about your order.
- Our Privacy Policy explains how we handle your information.
